Terminology

In these Terms and Conditions the following expressions have the meanings set out below:

Application means an application made by you for a Contract of Insurance with an Insurance Provider.

Contract of Insurance means a contract between you and an Insurance Provider to provide insurance for a particular risk and/or insurance cover.

Affordable Health means Affordable Health and Life Limited.

Insurance Provider means any of the insurance companies that promote and offer their products or services on this Website.

Services means any one or more of the Services offered by Affordable Health, including:

• The provision of a web based calculator to assess personal risk requirements
• The provision of a platform for the Insurance Providers to promote and offer their products and services to you
• The provision of information, research and other such material about Insurance Providers, products and services
• Assistance with the Application to be submitted by you to a participating Insurance Provider

Terms and Conditions means these Terms and Conditions and includes the Disclaimer Statement, Disclosure Document and Privacy Policy.

We/us/our is a reference to Affordable Health and Life Limited.

Website is a reference to any Affordable Health website through which the Services is offered.

You and your is a reference to the person or persons using the Website and/or making an Application.

Acceptance of Terms and Conditions
Affordable Health offers you access to the Service and Website subject to these Terms and Conditions. Each time you access this Service and Website, you confirm you have read and accept the Terms and Conditions. We may from time to time amend the Terms and Conditions in whole or in part. The amended Terms and Conditions will be effective immediately once posted on the Website. If you do not accept the Terms and Conditions, please refrain from using the Services and/or making an Application.

The Services
Affordable Health provides information, research and other such material about Insurance Providers and their products and services. In addition, Affordable Health provides a platform for Insurance Providers to promote and offer their products and services to you. Affordable Health will assist you with your Application but any Contract of Insurance will be formed between you and the Insurance Provider. All payments must be made by you directly to the Insurance Provider. Affordable Health will receive a fee from the Insurance Provider if your Application results in a Contract of Insurance being entered into between you and the Insurance Provider.

At Your Own Risk
Any transaction you enter into with an Insurance Provider including, without limitation, a Contract of Insurance between you and the Insurance Provider is conducted and completed entirely at your own risk. Neither Affordable Health no the Insurance Providers give any advice or make recommendations as to the suitability of cover. Affordable Health does not make any representations nor give any warranties in relation to any products or services promoted or sold by the Insurance Providers including:

1. Content, description, worthiness, suitability for any particular purpose, quality or legality of the products and services that are promoted and offered by the Insurance Providers on the Website
2. Whether any insurance or service offered by the Insurance Providers on the Website will meet your requirements or expectations.

Disclaimer
You expressly understand and agree that:

1. Your use of the Services is at your sole risk. The Website and Services are provided on an "as is" and "as available" basis. Affordable Health disclaims and excludes all implied conditions or warranties, including, but not limited to, any warranties of merchantability, fitness for a particular purpose and non-infringement or otherwise howsoever
2. Affordable Health does not warrant that:
• The Services provided will be uninterrupted, timely, secure or error free; or
• That any information provided on the Website is accurate, error free or reliable.
3. No information or advice that is obtained by you from Affordable Health or anyone else shall create any warranty by Affordable Health whatsoever; and
4. The products and service promoted and offered by the Website by the Insurance Providers are only available to New Zealand residents. The decision as to whether or not to accept your Application will be made by the particular Insurance Provider to whom you have applied and not by Affordable Health.
5. While Affordable Health may provide links to other websites Affordable Health will not be responsible for the content of those websites. Affordable Health takes steps to check third party websites for suitability; however it does not endorse nor make any representations about the material and information found on such websites nor accept any responsibility for the way in which such material and information may be used or applied.

Liability
You agree that to the maximum extent permitted by law any and all liability and responsibility of Affordable Health to you or any other person under or in connection with the Terms and Conditions, or in connection with the Services, this Website, or your use or in-ability to use, the Services or this Website is excluded regardless of whether such liability arises in contract, tort (including negligence), equity, breach of statutory duty or otherwise. The liability and responsibility of Affordable Health is excluded in respect of any and all loss or damage, whether direct or indirect, including, without limitation, loss of profits, loss of data, loss of business or anticipated savings, general and special damages and consequential and incidental loss.

Indemnity
You agree to release, indemnify and keep us indemnified from and against all actions, claims, costs (including legal costs and expenses), losses, proceedings, damages, liabilities or demands suffered or incurred by us to any person arising out of, or is in connection with, your failure to comply with these Terms and Conditions or arising out of any Application you submit to an Insurance Provider.

Breach
Without limiting any other rights and remedies available to Affordable Health, Affordable Health may in its absolute discretion limit your activities on the Website or refuse to provide the services to you if you breach the Terms and Conditions.

System Integrity
Affordable Health will undertake all reasonable steps to ensure the availability of the Website and Services, subject to any downtime required for maintenance. However, Affordable Health takes no responsibility for any system unavailability, or for any loss that is incurred as a result of the Website or Services being unavailable. Further, Affordable Health assumes no responsibility for the corruption of any data or information held by Affordable Health.

Resolution of Disputes
As Affordable Health is not a party to any Contract of Insurance that you enter into with a Participating Insurance Company, you agree not to involve or attempt to involve Affordable Health in any dispute or in the resolution of any dispute that might arise between you and an Insurance Provider.

No Waiver By Failure to Exercise or Enforce
If we do not exercise or enforce any right available to us under the Terms and Conditions, it does not constitute a waiver of those rights.

Partial Invalidity
If any provision of the Terms and Conditions becomes or is held to be invalid, unenforceable or illegal for any reason, and in any respect, that provision shall be severed from the remaining Terms and Conditions, which shall continue in full force and effect.

Governing Law of the Website
The Terms and Conditions are governed by the laws of New Zealand. You submit to the non-exclusive jurisdiction of the Courts of New Zealand.

Intellectual Property Rights Affordable Health (and its licensors or suppliers as the case may be) owns all proprietary and intellectual property rights in the Website (including text, graphics, logos, icons etc) and the software and other material underlying and forming part f the Services and the Website. Unless you have the prior written consent of Affordable Health, you may not, in any form or by any means:

1. reproduce, adapt, copy, store, distribute, print, display, publish or create derivative works from any part of this Website
2. copy, commercialise, on-sell any information or items obtained from any part of this Website

Case Studies
In this Website case studies are based on actual claims, however, some information has been changed to protect the privacy of the persons involved.

Application of this Entire Agreement
These Terms and Conditions supersede all previous conditions, undertakings, commitments, agreements and representations whatsoever, whether oral or written, and constitute the entire agreement between you and us relating to the subject matter of the Terms and Conditions.

Privacy
Affordable Health collects personal information about you through your use of the Website and Services including, without limitation, your name, address, telephone number, e-mail address, financial details, password and other information from which you can be identified and information relating to your use of the Website and the content you access. You agree that Affordable Health may use this personal information as set out in the Privacy Policy. Please read our Privacy Policy for important information regarding the use of your personal information and your rights in relation to it. Your relationship with Affordable Health and the use of the Website is governed by these Terms and Conditions, the Privacy Policy and the Disclaimer Statement. Please read and become familiar with all of them before proceeding.
